Civil Procedure Code, 1908 — Section 47 — Execution proceedings — Scope of Executing Court — Executing Court is empowered to decide questions relating to execution, discharge or satisfaction of decree — However, it has no jurisdiction to go behind or beyond the decree — It must execute the decree as it stands without altering its terms. Execution of decree — Variation/modification — Impermissibility —

Executing Court cannot modify, vary or reallocate rights determined under decree — Alteration of portions of property allotted to parties under compromise decree amounts to acting beyond jurisdiction and is unsustainable.

Compromise decree — Execution — Binding nature —

Terms of compromise decree, where property shares are clearly defined, must be strictly enforced — Practical difficulties or subsequent developments cannot justify deviation from decree.

Executing Court — Role — Not a trial court —

Executing Court cannot assume role of trial court or substitute its own view for terms of decree — Its duty is confined to enforcement of decree as passed.

Exception — Nullity of decree —

Only exception to rule that Executing Court cannot go behind decree is where decree is a nullity for lack of inherent jurisdiction — In absence of such nullity, decree must be executed as it is.

Reciprocal obligations — Execution — Scope —

Where decree contains reciprocal obligations, Executing Court may ensure compliance of such obligations — However, it cannot alter substantive terms of decree under guise of implementation.

Identity of subject matter — Limited inquiry —

Executing Court may determine issues relating to identity of property or subject matter for proper execution — But where identity is clear, no modification is permissible.

RATIO DECIDENDI

An executing court cannot go behind or vary the terms of a decree and must execute it as it stands; its jurisdiction is limited to enforcement, and only in cases of nullity or issues of identity can it make limited inquiries, but it cannot modify substantive rights determined under the decree.

  • Orders of Executing Court modifying decree set aside
  • Direction to execute decree strictly as per its terms
